The essence of the attorney-client relationship is
confidentiality. Yet there are
circumstances in which confidential information can be disclosed. RAP 1.6 is complex, and made more so by
voluminous commentary and interpretations. It is the purpose of this CLE to provide attorneys with a
concise one-hour overview of the key ethical obligations pertaining to
confidential communications so they can spot potential problem issues as they
arise in practice.

12:00-12:15 Scope of the Duty. What information is covered by the rule? What is the scope of the duty to preserve confidentiality, and what steps must be taken?
12:15-12:25 Client Consent or Authorization. What’s the meaning of informed consent by the client, and what formalities pertain? When has the client impliedly authorized disclosure, and how far does that extend?
12:25-12:40 RAP 1.6(b) Disclosures: Prevention of Harm, Crimes or Injury. We consider the scope of permitted disclosures under RAP 1.6(b)(1)-(3).
12:40-12:50 RAP 1.6(b) Disclosures: Disputes Between Lawyer and Client. We consider the scope of permitted disclosures under RAP 1.6(b)(5).
12:50-1:00 Other Permitted Disclosures. We consider other permitted disclosures, under RAP
1.6(b) and other applicable law.
